This Privacy Policy (“Privacy Policy”) governs how and when Heroes Linked and the Military and Veterans Appreciation Trust Foundation (the “Heroes Linked Parties,” “us,” “our” and “we”) collects, uses, and shares your information when you use our services with respect to the Heroes Linked Web App (the “Web App”), the Heroes Linked Website (the “Website”), and the application process for the Heroes Linked’s advising program (the “Program”). We are committed to protecting your privacy and the integrity of your personal information, and take seriously our efforts to do so. Please carefully review this Privacy Policy before using or accessing the Web App, the Website, or applying to the Program. By using and/or accessing the Web App or the Website, you confirm that you have reviewed, understand, and do not object to this Privacy Policy and agree to its terms. Do not use or access the Web App or the Website if you do not agree to any or all of this Privacy Policy’s provisions.

Consent

This Privacy Policy applies to our Website and our Web App. All such use, including any dispute relating to privacy is subject to this Privacy Policy and the applicable Terms of Use. We are not responsible for the privacy policy or content of any third party website linked to our Website or Web App. Please check with these third party organizations or companies for their specific privacy policies.

Information Collection

Generally, the Heroes Linked Parties do not collect personal information from you when you visit the Website unless you choose to provide such information, and you can visit most portions of the Website without disclosing any personal information. When you submit an application to receive support from the Program (a “Advisee Application”) or submit an application to provide advising through the Program (a “Advisor Application”), such applications will require you to share personal information about yourself, including your name, street, city and state address, zip code, e-mail address, telephone number, age, employment status, Veteran status, educational background and other background information, including any criminal offenses. For Advisee Applications submitted online, applicants may attach their résumés, but such an action is not required. Once an applicant is accepted into the Program, the Heroes Linked Parties will request information regarding the applicant’s service record and career, which may be submitted via ID.me, e-mail, mail or fax. Advisee and Advisor applications may also be printed and then submitted in paper form to the Heroes Linked Parties. If you do not provide all of the information necessary to process your application, your application may be delayed or denied, particularly where information is required by law. The Advisee and Advisor applications may also request additional optional information, which you may provide at your discretion. You have the right to withhold personal information when visiting the Website; however, your doing so may preclude you from submitting an application and participating in the Program. You also have the right to withhold personal information that is identified as “optional,” although the Heroes Linked Parties expressly reserve the right to reject your Advisee or Advisor Application based on your decision to do so. Subject to contractual and legal restrictions, you may withdraw your consent to release personal information at any time upon reasonable notice. However, if you do so we may determine that you are precluded from further participating in the Program, and expressly reserve the right to do so. Furthermore, the Heroes Linked Parties shall not be responsible, under such circumstances, for securing your personal information from authorized third parties, although it may elect to do so.
Your account name, photo and other user-generated content posted in connection with the Web App, Website or Program may be displayed publicly. Please take special note that your user profile and any user-generated content that you post in connection with the Web App, Website or Program, including any photographs or personal information, will be publicly accessible in the Web App, Website or Program and may be used in accordance with the Terms of Use.

Your Communications

When you send an e-mail to our webmaster or a message through our Website, we store those communications in order to respond to your inquiries and enhance user service.

Links to Internal Webpages

Links on our Website may be formatted in a manner that enables us to track who is clicking the links by IP address, as well as when and how often the links are clicked in order to improve our content and service.

Links to Other Sites

Our Website may contain links to third party websites operated by individuals or organizations unrelated to our organization. Please be aware that we are not responsible for the privacy practices of any third party websites. These linked websites are for your convenience only. You access them at your own risk. We recommend that you review the privacy policies posted on such third party websites prior to using them.

Information Use

We may use your personal information to communicate with you regarding the Web App or the the Website, to assess your candidacy for the Program as either an advisee or a advisor, to facilitate your participation in the Program, and to address disputes or inquires submitted by you. Any personal information submitted to us, or to our third-party service providers acting on our behalf, will not be sold, leased or shared with or to anyone else by us, unless we notify you otherwise in advance, except as follows:

  1. We may share your personal information with the references you have provided to us as part of the Program application process in order to verify the information you have entered on your Advisee or Advisor Application.
  2. We may share your information with our third-party service providers, to the extent that they reasonably require such information in order to provide their services.
  3. We may disclose your information to comply with any judicial or governmental subpoenas, warrants or orders. We also reserve the right to use, disclose and share your information to investigate, prevent or take action with respect to any potential or actual fraud, illegal activities, circumstances which threaten the physical safety of any person, violations of the Web App’s or Website’s Terms of Use or as otherwise required by law. However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your information.

Security

We employ security measures, such as SSL encryption methodology and the use of passwords and usernames to attempt to limit the accessibility of personal information to the Heroes Linked Parties’ staff, and to help prevent the unauthorized access, disclosure, loss or destruction of personal information. However, as no system is absolutely secure, we cannot guarantee that the information we have gathered will never be accessed, disclosed, lost or destroyed in a manner that is inconsistent with this Privacy Policy or the preferences of Web App or Website users. However, several protocols are in place to protect your information.

Revising/Deleting Your Personal Information

You may contact the Heroes Linked Parties at info@heroeslinked.org if you wish to withdraw the information submitted on your Advisee or Advisor Application. Notification of Changes

This Privacy Policy may be amended or modified at the sole discretion of the Heroes Linked Parties and new provisions may be incorporated at any time without notice. This Policy will be periodically updated to reflect these changes and additions, and we encourage you to check the Privacy Policy on an ongoing basis to review such changes. Unless you affirmatively request to withdraw your personal information, changes to this Privacy Policy will automatically apply to your information, regardless of whether you continue to use the Website or are aware of such changes. By continuing to access or use the Web App and/or Website after those changes become effective, you agree to be bound by the revised Privacy Policy.

Choice of Law

Any disputes arising between you and Heroes regarding this Privacy Policy shall be governed by the laws of the Commonwealth of Virginia without regard to its conflict of law provisions. In submitting your personal information to the Heroes Linked Parties, you expressly agree to submit to the personal and exclusive jurisdiction of the state courts of the Commonwealth of Virginia and to the Alexandria Division of the United States District Court for the Eastern District of Virginia, and you hereby waive any argument that such courts do not have jurisdiction over you or that venue in any such courts is not appropriate or convenient. The Heroes Linked Parties will be entitled to recover their court costs and reasonable attorney’s fees and expenses incurred if they successfully prove your violation of any term of this Privacy Policy.
